Basis for Section 3116 Determination for Salt Waste Disposal
The Department of Energy (DOE) published in the Federal Register (January 24,
2006), a Notice
of Availability of Section 3116 Determination for Salt Waste Disposal at the
Savannah River Site.
The NDAA Section 3116 basis of determination for the disposal of separated,
solidified, low-activity salt waste at the Savannah River Site near Aiken,
South Carolina was signed by the Secretary of Energy on January 17, 2006. The
determination was prepared pursuant to Section 3116 of the Ronald W. Reagan
National Defense Authorization Act for Fiscal Year 2005. The Final NDAA Section
3116 Waste Determination report and attachments including the Nuclear
Regulatory Commission Request for Additional Information (RAI) with the DOE
responses to those RAIs, NRC Action Items information request with the DOE
responses to the action item request. NRC published their consultation report,
called the Technical Evaluation Report which is available on the NRC web page.

Several documents support the information in the waste determination and DOE has
included links to those documents in order to assist the reader. For example, a
National Environmental Policy Act (NEPA) Record of Decision (ROD) was revised
to reflect the Department’s decision to modify the treatment strategy for
low-activity salt waste residuals. While the ROD is made available on a
different DOE web page, we have provided the link to that web page in order to
ease access to information that is related to this waste determination. DOE
also made the draft waste determination available for public review and
comment. Responses to public comments on the draft waste determination are
provided. Finally, we have provided the salt waste disposal performance
assessment, called the Performance Objective Demonstration Document (PODD) due
to the helpful supporting information contained in that report. Follow the
