Memorandum of Understanding Between the United States Department
of Energy and the Washington State Department of Ecology for Development of the
Hanford Site Tank Closure and Waste Management EIS ("TC&WM EIS")
The purpose of this MOU is to define the responsibilities of each agency in preparation
of the EIS. For the purposes of this MOU, DOE and Ecology (the Parties) agree that
the most effective relationship shall be one in which DOE serves as the "Lead Agency"
and Ecology serves as the "Cooperating Agency" as defined in the CEQ regulations
(40 C.F.R. Part 1508).
Settlement Agreement re: Washington v. Bodman
The overarching goal of this Settlement Agreement is to resolve the litigation and
improve the relationship between DOE and Ecology to be more cooperative and collaborative.
This Agreement is intended to resolve Ecology's groundwater analysis concerns in
the HSW EIS and to provide an approach to analyze waste management actions at the
Hanford Site.

in the Solid Waste EIS.
Notice of Availability of Final Section 3116 Determination for Salt Waste Disposal
at the Savannah River Site
The Department of Energy (DOE) announces the availability of the Final Section 3116
determination for the disposal of separated, solidified, low-activity salt waste
at the Savannah River Site (SRS) near Aiken, South Carolina. The determination was
prepared pursuant to Section 3116 of the Ronald W. Reagan National Defense Authorization
Act for Fiscal Year 2005. Section 3116 authorizes the Secretary of Energy, in consultation
with the Nuclear Regulatory Commission (NRC), to determine that certain waste from
reprocessing is not high-level waste (HLW) and that it may instead be disposed of
as low-level waste (LLW) if it meets the provisions set forth in Section 3116.
Notice of Availability of Draft Section 3116 Determination for Savannah River Site
Tanks 18 and 19.
This Notice announces the availability of a draft determination for the permanent,
in-situ disposal of residual tank wastes (including tank structure and equipment)
in liquid radioactive waste tanks 18 and 19 at the F-Tank Farm (FTF) at the Savannah
River Site (SRS) near Aiken, South Carolina. This determination addresses only the
permanent disposal of the residual materials contaminating Tank 18 and Tank 19,
as well as the structure of the tanks themselves and ancillary equipment. DOE prepared
the draft determination pursuant to Section 3116 of the Ronald W. Reagan National
Defense Authorization Act for Fiscal Year 2005. Section 3116 authorizes the Secretary
of Energy, in consultation with the Nuclear Regulatory Commission (NRC), to determine
that certain waste from reprocessing is not high-level waste (HLW) and that it may
instead be disposed of as low-level waste (LLW) if it meets the provisions set forth
in Section 3116. Although not required by the Act, DOE made the draft waste determination
available for public review and comment. That comment period is now closed and DOE
is developing a summary of the responses to public comments and completing the final
waste determination.
Notice of Availability of Draft Section 3116 Determination Idaho Nuclear Technology
and Engineering Center Tank Farm Facility
The Federal Register Notice announced the availability of a draft Section 3116 determination
for the disposal of grouted residual waste in the tank systems at the Idaho Nuclear
Technology and Engineering Center (INTEC) Tank Farm Facility (TFF). The determination
was prepared pursuant to Section 3116 of the Ronald W. Reagan National Defense Authorization
Act for Fiscal Year 2005. Section 3116 authorizes the Secretary of Energy, in consultation
with the Nuclear Regulatory Commission (NRC), to determine that certain waste from
reprocessing is not high-level waste and that it may instead be disposed of as low-level
waste if it meets the provisions set forth in Section 3116. Although not required
by the Act, DOE made the draft waste determination available for public review and
comment. That comment period is now closed and DOE is developing a summary of the
responses to public comments and completing the final waste determination.
